This is an application for regular bail in connection with Trial No. 2290/2017 arising out of Chanpatiya P. S. Case No. 141 of 1997 registered for the offences punishable under Sections 25(1-B)A and 26 of the Arms Act.

This is a case of misuse of privilege of bail. Petitioner was granted bail by the court below on 6.3.1998 and he used to appear before the court below till 11.1.2002. Since petitioner is a poor and illiterate person, on the wrong advice of advocate clerk he went outside for his livelihood and failed to attend court on the date fixed. His bail bond was cancelled on 11.1.2002. On getting knowledge of his cancellation of bail bond, he surrendered before the court on 15.7.2017. Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.14079 of 2018(3) dt.05-04-2018 2/2 let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Trial No. 2290 of 2017 arising out of Chanpatiya P.S. Case No. 141of 1997.
