06-09-2017 Heard Sri Anil Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the second attempt for grant of bail on behalf of the petitioner. Earlier, by order dated 27-10-2016 passed in Cr.Misc. No. 45747 of 2016, the prayer for bail of petitioner was rejected. The petitioner is in custody in Nawanagar P.S. Case No. 107 of 2013 registered for offence under Sections 25(1-AA)/25(1-B)a, 26, 35 of the Arms Act, 1959 and Sections 10, 13, 19, 20 of Unlawful Activities (Prevention) Act, 1967. The prayer for bail was rejected considering the antecedent of the petitioner as well as the fact that earlier he remained absconder.

However, in this case, by order dated 16-08-2017, a

Patna High Court Cr.Misc. No.32803 of 2017(3) dt.06-09-2017 2/2 report was called for from the court below regarding stage of the case, which has been received and kept at flag 'P'. The report suggests that petitioner had filed a petition for discharge under Section 227 of the Cr.P.C. The report suggests that only with a view to linger the commencement of trial, the said petition, despite filing, has not been pressed.

Considering the report as well as the fact that there is no substantial change in the circumstance, I do not find any ground to review my earlier order.

The prayer for bail again stands dismissed.
