JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 366 and 366A of the Indian Penal Code.

It is alleged that the minor daughter of the informant was kidnapped for the purpose of marriage.

It is submitted by the learned counsel for the petitioner that co accused Kundan Kumar Sah kidnapped the minor daughter of the informant. the victim in her 164 Cr.P.C. statement named the petitioner but the petitioner was not sent up for trial but differing with the final form cognizance has been taken and co accused Kundan has been granted bail on the ground

Patna High Court Cr.Misc. No.17462 of 2015 (2) dt.14-05-2015 2/2 of juvenility.

Considering the thrust of accusation against co accused Kundan Kumar Sah, the aforesaid submissions constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Bettiah Town P.S. Case No. 891 of 2012 pending in the court of learned CJM, Bettiah, West Champaran.

This application is disposed of with the aforesaid observation/direction.
