JUSTICE SANJAY PRIYA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in Ara Town P.S. Case No. 255 of 2017 instituted for the offence under Sections-25(ib)a/26/35 of the Arms Act. As per written report, live cartridges have been recovered from possession of the petitioner. The seizure list is annexed as Annexure-2 to this petition, which does not bear signature of both the petitioners.

It has been submitted that petitioners were not present on the spot. It has further been submitted that petitioner No. 1 namely, Shekh Ayaz @ Shekh Ajij was in PMCH on the alleged time of occurrence. Petitioners are said to be in custody since 12-

In such circumstances, prayer for bail is allowed and it is ordered that the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ara Town P.S. Case No. 255 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara subject to condition that both the bailors should be relatives of the petitioners.
