JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner is seeking regular bail in Ladaniya P.S. Case No. 135 of 2017 registered for the offence under Sections 363, 364(A), 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the victim boy was recovered from a particular place near a school from where the co-accused Mohan Kumar Pandey was arrested. This petitioner has been falsely implicated in the case on the basis of the confession statement of the co-accused. Learned counsel further submits that the victim boy has not taken his name and till date he has not been identified in connection with this case. Learned A.P.P. for the State is present.

Considering the facts and circumstances as also that

No.4812 of 2018 (2) dt.02-02-2018 2/2 the petitioner has no criminal antecedent, let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Madhubani in connection with Ladaniya P.S. Case No. 135 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Dilip, AR U T
