JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 This is an application for grant of anticipatory bail in connection with Khutauna P.S. Case No. 37 of 2018, disclosing offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38(1) (2) of the Bihar Prohibition and Excise Act, 2016.
Allegation as per F.I.R. is that police arrested one accused person and recovered 175 liters liquor from his motorcycle and he also disclosed that some liquor are kept in the house of the petitioner, on which police called the petitioner and from the house of the petitioner recovered 45 liters liquor. Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he has given the house on rent to one Mahesh Sah. Further, he has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Iind, cum Special Judge, Excise Act, Madhubani, in connection with Khutauna P.S. Case No. 37 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
