Petitioner seeks bail in a case registered for the offences punishable under Sections 376,420,506 of the Indian Penal Code.
The informant, who is a married lady since last 15 years alleges that she was in physical relation with the petitioner, as the petitioner had promised to marry with her.
Submission is that the informant is a consenting party, even if the allegation is assumed to be correct. Though the same is totally false. Petitioner is in custody since 06.12.2017. Investigation of the case is complete.
Patna High Court Cr.Misc. No.21631 of 2018 (2) dt.18-04-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mahila Police Station Case No.05 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
