The petitioner seeks bail in connection with Kalyanpur P.S.Case No.132/16 registered under Sections 272/273 of the I.P.C. and Section 47 (A) of Bihar Excise (Amendment) Act. Accusation is of recovery of 247 liters of Indian made foreign liquor from the brick kiln of the petitioner who happens to be the owner of the brick kiln.

Learned counsel appearing on behalf of the petitioner submits that though petitioner is owner of the brick kiln he had no knowledge of keeping the Indian made foreign liquor near his brick kiln. He is in custody since 29.5.2017. Having regard to the facts and the circumstances of the

No.38522 of 2017 (4) dt.11-10-2017 2/2 case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Samastipur, in connection with Kalyanpur P.S.Case No.132/2016.
