The petitioners seek bail in a case registered for offences punishable under Section 272, 273/34 of IPC and Sections 30 (a), 30 (d), 38 of Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 26 litres foreign liquor were recovered from the possession of the petitioners as they were selling liquor on the occasion of Holi festival. Petitioners claim that they are having clean antecedent and are in custody since 03.03.2018.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.20021 of 2018(2) dt.19-04-2018 2/2 the case, the above named petitioners are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Muzaffarpur in connection with Siwaipatti P.S. Case No. 17 of 2018. Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
