The petitioner is apprehending his arrest in a case registered under Section 7 (a) of Prevention of Corruption Act, 1988.
The prosecution case in short is that the accused person demanded bribe and thereafter in a trap conducted by the vigilance, the co-accused person was caught red handed. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation of demand of bribe is denied by the petitioner. The allegation of demand of bribe is against the
Patna High Court CR. MISC. No.20576 of 2020(5) dt.15-03-2021 2/2 Programme Officer who has been caught red handed. It is further submitted that the petitioner is ready to deposit a sum of Rs. one lakh in the court below which shall be subject to the final disposal of the case.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, on deposit of a sum of Rs. one lakh in the Court below which shall be subject to final disposal of the cas e , let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of eight weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, Bhagalpur in connection with Special Case Vigilance No. 14 of 2018, arising out of Vigilance P.S. Case No. 38 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
