This is an application for regular bail in connection with Begusarai Town P.S. Case no. 537 of 2017 registered for the offences punishable under Sections 379, 414 and 413 of the Indian Penal Code.
Allegation against petitioner is of theft of motorcycle. It has been submitted by learned counsel for the petitioner that he is innocent and his name has surfaced on the confessional statement of co-accused Rajnish Kumar. He is owner of the motorcycle and he has no concern with the stolen motorcycles. He has no criminal antecedent and he is in custody since 28.9.2017. It has further been submitted that similarly situated co-accused, namely, Raja Babu and Md. Ajmat have been granted bail by different Benches of this Court
Patna High Court Cr.Misc. No.6434 of 2018(3) dt.27-02-2018 2/2 vide Cr. Misc. no. 5291 of 2018 and Cr. Misc. no. 2097 of 2018 respectively.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai, in connection with Begusarai Town P.S. Case no. 537 of 2017.
