JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 406, 409, 420, 467, 468 and 120-B of the Indian Penal Code.
The allegation against the petitioner is of misappropriation and embezzlement of public money in construction of Kasturba Gandhi Girls School Building at Phenhara, under the district of East Champaran. The petitioner has been made accused in this case, as she was the Secretary of Shiksha Samiti. It is the petitioner's plea that there is no allegation in the First Information Report

No.17580 of 2015 (4) dt.30-07-2015 2/2 of entrustment of any amount to her nor there is any allegation that she issued any cheque in the matter relating to construction of the said school building. Learned counsel for the petitioner has further submitted that the petitioner being a lady, there is no chance of her absconding from the course of investigation or trial. He submits that the petitioner will cooperate with the police in course of investigation and shall present herself before the police or the Court as and when required. In view of the submission as above, let the petitioner, abovenamed, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Phenhara P.S. Case No. 24 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
