JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The petitioner, who is presently Branch Manager of Uttar Bihar Gramin Bank, Sohagara Branch, District- Siwan, apprehends arrest in Puraini P.S. Case No. 104/2014 instituted under Sections 467,468,471,420,409/34 of Indian Penal Code. It is alleged by the informant that when the officials of the Bank came to make enquiry, he learnt that in his name certain loans have been sanctioned. When he went to the Bank to make enquiry, he found that several other persons have also been sanctioned loan. No paper with regard to his loan could be traced. The loan was sanctioned and allegedly disbursed during the tenure of the petitioner.
Learned counsel for the petitioner states that he is not
Patna High Court Cr.Misc. No.17262 of 2015 (2) dt.08-06-2015 responsible for the same. Parties execute all documents and receive agriculture loan and when they fail to pay the same they make different complaints.
Be that as it may, till submission of charge sheet, upon the petitioner surrendering in the court below within four weeks from today, he (Rajendra Prasad Bhagat @ R.P. Bhagat) shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Pradip Kumar Choudhary, Judicial Magistrate, Ist Class, Udakisunganj, Madhepura in Puraini P.S.Case No.104/2014 subject to all conditions as laid down in Section 438
(2) of Criminal Procedure Code.
