JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 458, 382, 307 and 411/34 of the Indian Penal Code as well as Sections 25(1-b)a, 26 and 35 of the Arms Act in connection with Sikandara P.S. Case No. 148/2016.

Allegation, as per the F.I.R., is that some accused persons assembled in the shop of the informant having armed with weapons and thereafter on hulla the police reached there and caught two criminals. They disclosed the name of this petitioner. It has been submitted on behalf of the petitioner that nothing has been recovered from possession of the petitioner and

Heard learned Additional Public Prosecutor also. Having heard both sides, in view of the facts, stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jamui, in connection with Sikandara P.S. Case No. 148/2016, subject to the conditions that one of the bailors must be local bailor and another having sufficient immovable property within the jurisdiction of the court below with further condition that he will co-operate in disposal of the trial and will make himself available before the court and failure to appear on two consecutive dates without any appropriate reason will be liable for cancellation of his bail.
