NILU AGRAWAL ORAL ORDER 04-07-2017 Petitioner is permitted to make necessary correction in the prayer portion of the petition. Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody since 18.04.2017 in connection with Case No. C-2/22/241/17 for offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act.

The prosecution case is that SSB, Sitamarhi through nakabandi apprehended the petitioner carrying nine litres of Nepali sophy wine in 30 bottles in his bicycle. Accordingly, a seizure-list was prepared.

It has been submitted by the learned counsel for

No.25816 of 2017 (3) dt.04-07-2017 2/2 the petitioner that he is innocent, bears no criminal antecedent and has falsely been implicated in the aforesaid case as nothing has been recovered from his conscious possession. However, learned APP for the State opposes the prayer for bail.

Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-II-cumSpecial Judge, Bihar Prohibition and Excise Act, Sitamarhi, in connection with Case No. C-2/22/241/17.
