JUSTICE MADHURESH PRASAD ORAL ORDER 24-01-2018 Heard learned counsel for the petitioner and the State. It s submitted by the petitioner's counsel that in spite of order of his Court dated 20.9.2017, passed in Cr.Mis.No. 45344 of 2017 granting bail to the petitioner, he could not be released due to non-fulfilling of condition no.2 which requires that the petitioner should give an affidavit that he is not accused in any other case prior to the instant case.

Counsel for the petitioner submits that other than the instant case, the petitioner is accused in two other cases details of which has been mentioned in paragraph 3 of the bail application, in which he is already on bail.

Considering the aforesaid submission, let condition no.2 in order dated 20.9.2017 be ignored while processing the bail bonds of the petitioner and to this extent the order is modified. (Madhuresh Prasad, J) Shashi.
