Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 21(a) of N.D.P.S. Act.

Allegation against the petitioner is that 8.370 Gram Smack like substance was recovered from the possession of the petitioner which was kept in 20 Puriya.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Recovery of Smack is of less than commercial quantity The petitioner is also accused in one more criminal case. The petitioner is in custody since 04.12.2021. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail after framing of charge on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 2nd Muzaffarpur, in connection with N.D.P.S. Case No. 12 of 2022 arising out of University P.S. Case No. 16 of 2021. The application stands allowed.
