JUSTICE ARUN KUMAR JHA ORAL ORDER 08-07-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceeding. Let the defect(s), if any, as pointed out by the office be removed within four weeks from the date of resumption of physical filing and physical removal of defect. In the present case, the petitioners seek bail in connection with Excise Case No. 32 of 2022 registered for the alleged offences under Section 30 (a) and 56(b) of the Bihar Prohibition and Excise Amendment Act, 2018.

Allegedly from the vehicle of the petitioners, 162 liters of India made foreign liquor was recovered.

Learned counsel for the petitioners submits that the petitioners have no concern with the seized articles and they have

Patna High Court CR. MISC. No.14263 of 2022(2) dt.08-07-2022 2/3 been falsely implicated in this case. They are not engaged in business of liquor. The petitioners are in custody since 20.01.2022. Learned A.P.P. for the State has opposed the prayer for bail of the petitioners.

Having regard to the submissions made hereinabove and considering the quantity of liquor recovered and the period of custody of the petitioners, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Judge No.-3, Gaya in connection with Excise Case No. 32 of 2022, subject to the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioners will remain present on each and every date fixed by the court below.

(iii) In case of absence for three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
