2. The petitioner apprehends his arrest in a case registered for the offence under Section 317(5) of the Bhartiya Nyaya Sanhita, 2023 and Section 30 (a) of Bihar Prohibition and Excise Act.
3. As per F.I.R., 72 liters of Nepali Saufi wine has been recovered from a seized motorcycle and apprehended coaccused Nawal Kumar disclosed the name of petitioner and others, who fled away from spot.
4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of the seized motorcycle and has been made accused only on confession of co-accused, who was apprehended on spot. Petitioner has got one criminal antecedent of similar nature, in which, he is on bail.

5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Sitamarhi in connection with Majorganj P.S. Case No. 429 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
