The petitioner is in custody since 30.05.2017 in connection with Naya Ramnagar P.S. Case No. 88/17 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that only on the basis of the suspicion, the present petitioner has been taken into custody. He has no criminal antecedent and on the basis of the statement that he was 'last seen' with the deceased, therefore, it was presumed that the petitioner had played a role in the murder of the deceased.
Considering the nature of allegations made against the petitioner and that he has no criminal antecedent, let
