1. Heard the parties.
2. The petitioner by way of this writ petition claims promotion on the post of Dy. S.P. on the ground that persons junior to him have been promoted on the said rank.
3. Counter affidavit has been filed and it has been stated that the petitioner was promoted as Inspector of Police in year 1999 and none of the Police Inspector promoted in the year 1999 have been further promoted to the rank of Dy. S.P. before the date of superannuation of the petitioner i.e. 31.10.2011.
4. In view thereof, it has been prayed by learned counsel for the respondents that the petitioner does not have any rightful claim.

5. I have considered the submissions and heard learned counsel for the petitioner.
6. The petitioner has not been able to show any document of any junior police inspector promoted along with in the year 1999 or thereafter to have been promoted as Dy. S.P. prior to his retirement on 31.10.2011. As there is no discrimination on part of the respondents, and no other person has been promoted below the petitioner prior to his retirement, the claim of the petitioner is not made out.
