The petitioner seeks bail in Aurangabad Town P.S. Case No. 240 of 2017 registered under Sections 399, 402 and 414 of the Indian Penal Cod and Sections 25(1-b)a, 26 and 35 of the Arms Act.

On a tip off of convergence of some miscreants for plundering the jewelry shop, the police apprehended the petitioner giving chase and recovered and seized one loaded country made pistol and one live cartridge from his possession. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious

Patna High Court Cr.Misc. No.24416 of 2018 (2) dt.25-04-2018 2/2 physical possession of the petitioner. Seizure list witnesses are not the independent witnesses rather police personnel. The petitioner has been languishing in custody since 28.07.2017. Earlier bail petition of the petitioner was rejected by this court vide order dated 15.11.2017 with liberty to renew his prayer for bail after four months or framing of charge whichever happens earlier. Charge in the case has not been framed as yet, but four months have elapsed since the aforesaid order.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 240 of 2017.
