Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. The petitioner who is in custody since 20.9.2020 seeks bail in connection with Sessions Trial No. 391 of 2020 arising out of Bakhtiyarpur P.S. Case No. 221 of 2020 for the offence punishable under sections 413, 414/34 of the Indian Penal Code.

The prosecution case in brief is that the petitioner was caught with stolen motorcycle alongwith other co-accused bearing registration no. BR01GS-6379.

Learned counsel appearing on behalf of the petitioner submits that similarly placed co-accused one Deepak Kumar

Patna High Court CR. MISC. No.24137 of 2021(3) dt.30-11-2021 2/2 who was also caught with the aforesaid motorcycle, has already been released on bail vide order dated 31.8.2021 passed in Cr. Misc. No. 30697 of 2021. He further submits that the petitioner has clean antecedent and he is in custody since 20.9.2020. Considering the aforesaid facts, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Barh, Patna, in connection with Sessions Trial No. 391 of 2020 arising out of Bakhtiyarpur P.S. Case No. 221 of 2020 subject to the following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Purnendu Singh, J) Ravi/- U T
