====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-07-2017 The petitioner seeks bail in connection with Bhagalpur Rail P.S. Case No. 73 of 2017 registered for offences punishable under Section 379/411 of the Indian Penal Code The allegation against the petitioner is that on 24.04.2017 the petitioner pick pocketed of the informant and the petitioner was arrested at the spot and stolen amount of Rs. 3000/- cash was recovered from the petitioner.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has no criminal antecedent against him. Petitioner has been languishing in jail about two and half months.

Having heard both side, in view of the facts and
Patna High Court Cr.Misc. No.33757 of 2017 (2) dt.21-07-2017 circumstances of the case that he has been arrested on the spot by the travelers, as such, I am not inclined to grant bail to the petitioner. However, considering the fact that petitioner is in custody since 24.04.2017, learned A.C.J.M., Railway, Bhagalpur is directed to conclude the trial within a period of 5 months. In case the trial is not concluded within a period of 5 months, the petitioner would be at liberty to renew his prayer for bail. With the above observation, this application is dismissed.
