NILU AGRAWAL ORAL ORDER 04-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
Petitioners seek bail in connection with Amarpur P.S. Case No. 467 of 2016 registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code. The prosecution case, as lodged by the father of the deceased, Kiran Devi, is that his second daughter was married to one Sanjay Das 5-6 years back and there was some quarrel between the husband and the wife, but on 06.11.2016 his daughter went missing and was recovered dead from a well. It is submitted by the learned counsel for the petitioners that they are in-laws of the deceased and have been falsely implicated in the aforesaid case. It has further been
Patna High Court Cr.Misc. No.25822 of 2017 (2) dt.04-07-2017 2/2 submitted that although they have been named in the First Information Report, but there is no allegation of demand of dowry or torture or harassment by any of the petitioners on the deceased. He further submits that two sister-in-laws (Nanad), who have been named in the First Information Report, have since been granted the privilege of anticipatory bail by this Court and the husband Sanjay Das is in custody.
However, learned A.P.P. for the State opposes the prayer for bail.
Be that as it may, let the petitioners, named above, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 467 of 2016.
