====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-08-2024 Heard learned counsel for the petitioner, informant and learned APP for the State.

2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 302, 304B/34 of the Indian Penal Code, registered in connection with Chutia Sahayak P.S. Case No. 33 of 2023.

3. The allegation against the petitioner along with others is of killing the daughter of the informant due to nonfulfillment of further dowry demand.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. Petitioner is the husband of the deceased. During investigation, it has come that the deceased committed suicide by hanging herself and when the police went to the place of occurrence, the investigating team found the door was locked from inside and after breaking the same, the investigation team entered inside the room, which shows that the deceased herself committed suicide. There is no prior complaint with regard to the assault, torture and demand of dowry against the petitioner. Petitioner is a person of clean antecedent and he is in custody since 04.07.2023.

5. Learned APP for the State has opposed the prayer of bail and submitted that petitioner is named in the FIR and he is the husband of the deceased. He submitted that the sole responsibility of taking care of his wife (deceased) is against the petitioner but he did not do so. He further submitted that the deceased had died in her matrimonial house within one year of her marriage. During investigation, several witnesses have supported the prosecution case.

6. Considering the above facts and circumstances of the case as well as the nature of allegation, this Court is not
