2. The petitioner seeks bail in connection with Abadpur P.S. Case No. 26 of 2024 registered for the offence punishable under Sections 341, 323, 376 and 354(B)/34 of the Indian Penal Code.
3. The allegation against the petitioner is of committing rape upon the informant on the pretext of marriage.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 05.09.2024.
5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer
Patna High Court CR. MISC. No.16167 of 2025(6) dt.23-07-2025 2/2 for bail.
6. From the statement of victim girl recorded under Section 164 Cr. P.C., it appears that the petitioner and the victim girl were in a relationship.
7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Katihar/ concerned Court in connection with Abadpur P.S.
