The petitioners have challenged the order 28.06.2011 passed by the learned Chief Judicial Magistrate, Purnea in Sessions Trial No. 1264 of 2011, arising out of Complaint Case No. 3084 of 2008 whereby cognizance has been taken against the petitioners under Sections 302, 201/34 of the Indian Penal Code.

After having gone through the order of

Patna High Court CR. MISC. No.16758 of 2015(2) dt.15-05-2019 2/2 cognizance and the materials brought forth in the petition, this Court is not inclined to interfere with the order of cognizance.

The learned counsel for the petitioners is also not in a position to state about the stage of the case. However, the petitioners would be at liberty to approach the Court below and seek discharge, if such petition has already not been filed and disposed off. If the case is running trial, the Trial Court shall conclude the proceedings as early as possible.

With the aforesaid observation, the petition stands dismissed.
