The petitioner seeks bail in a case registered under Sections 272 & 273 of the Indian Penal Code and Section-30(A) of the Bihar Prohibition and Excise Act.
The prosecution case, in short, is that 502 liters wine is recovered.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-02-2019. The name of the petitioner has transpired in this case on the basis of disclosure made by co-accused Binod Kumar. It is alleged that 502 liters wine is recovered from the truck in question. The other co-accused namely Binod Kumar @ Binod
Patna High Court CR. MISC. No.13327 of 2019(3) dt.12-04-2019 2/2 Kumar Mahto with similar allegation has been granted bail by a coordinate bench of this court vide order dated 13-03-2019 passed in Cr. Misc. No. 615 of 2019. There is no compliance of Section 100 Cr.P.C.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Sonbarsa P.S.
