The petitioner seeks regular bail in connection with Banka (Barahat) P.S. Case No. 152 of 2017 registered for the offences punishable under Sections 341, 323, 307, 448, 379, 504 of the Indian Penal Code and Sections 3 and 4 of the Explosive Substances Act.

The informant has alleged that on 13.03.2017, this petitioner committed theft in his house. He took away a box containing Rs. 70,000/- cash and ornaments. The son of the informant woke up and saw the petitioner fleeing away and the informant went at the place of the petitioner to interrogate about the theft committed by him whereupon he abused, assaulted and

It has been submitted that the petitioner is the neighbour of the informant and he has lodged this case with false and frivolous allegation only to harass the petitioner. The petitioner has clean antecedent and he is in custody since 14.03.2017. Nothing has been recovered from his possession. Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S.
