This application is for grant of regular bail in connection with Excise Case No.55 of 2017 Shahpur 50 of 2017 for the offences under Sections 30(a), 56(d), 53 Excise Act and 25 (1-b)d, 26 and 35 of the Arms Act.
Allegation against the petitioner is of recovery of one country-made pistol and 20 cartridges.
Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and now he is in custody for about three months. The petitioner has clean antecedent.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.32392 of 2017 (2) dt.14-07-2017 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of five months and if not concluded, the petitioner is at liberty to renew his prayer for bail.
With the aforesaid observation, this application is dismissed.
