JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-04-2018 The petitioner is apprehending his arrest in connection with Sahebganj P.S. Case No. 209/15, registered for offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.

Allegation is of causing dowry death of the deceased. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R and he has no role to play in the death of the deceased and F.I.R itself shows that there was love marriage of the petitioner with the deceased and after marriage the demand was made by the co-accused of this case and not by the petitioner.

Learned counsel for the State opposed the prayer for bail and submitted that the deceased died in her Sasural and accused

Patna High Court Cr.Misc. No.3949 of 2018 (3) dt.10-04-2018 2/2 persons without informing the informant and others, have disposed of the dead body of the deceased.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below within a period of four weeks and pray for regular bail and if any such application is filed, the court below shall disposed of the same on the basis of materials available in case diary.
