JUSTICE ARUN KUMAR ORAL ORDER 19-02-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks bail in connection with Bhabhua P. S. Case No. 758 of 2017, registered under Sections 147, 148, 149, 188, 332, 196, 353, 505, 341, 151, 152, 153 (A) and 295A of the Indian Penal Code. Allegation in brief is that a person has posted some vulgar matter on the face book, as a result, other communities made protest, formed unlawful assembly and violated the order promulgated under Section 144 Cr. P. C.

Submission is that there is general and omnibus allegation against large number of people regarding creating

Patna High Court Cr.Misc. No.9792 of 2018 (2) dt.19-02-2018 2/2 communal flare, however similarly situated co-accused person has been granted bail by a Co-ordinate Bench of this Court on 06.02.2018 passed in Cr. Misc. No. 6720/2018 and the petitioner is in custody since 05.12.2017.

Having considered the said facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabhua (Kaimur) in connection with Bhabhua P. S. Case No. 758 of 2017.
