====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard Mr. Manoj Kumar along with Mr. Anand Prakash, the learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Kumarkhand P.S. (Distt-Madhepura) Case No. 87 of 2021 lodged under Sections 302/34 of I.P.C. read with Section 27 of Arms Act. F.I.R. has been lodged under Section 302/34 of the I.P.C. In the F.I.R. there were 5 names, on whom doubt have been created by the informant himself.
Learned counsel for the petitioner submits that petitioner and informant belong to the same village and there was no doubt created by the informant in the F.I.R. Subsequently his name has figured by the restatement of the informant and by the subsequent witnesses. Petitioner is in custody since 25.09.2021,
Patna High Court CR. MISC. No.14720 of 2022(2) dt.06-07-2022 2/2 charge sheet has already been filed in this case and there is no criminal antecedent of the petitioner.
Learned counsel for the State opposes the prayer for bail.
Considering the facts and circumstances of the case that informant himself created doubt on the petitioner, who is in custody since 25.09.2021, charge sheet has already been filed in this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousands) with two sureties of the like amount each to the satisfaction of learned 4th A.C.J.M., Madhepura, District Madhepura in connection with Kumarkhand P.S. (Distt-Madhepura) Case No. 87 of 2021 (Arising out of Kumarkhand, (Distt- Madhepura) P.S. Case No.87 of 2021), subject to the conditions as laid down under Section 437(3) of Cr.P.C.
