2. The petitioner is in custody in connection with Khusrupur P.S Case No. 496 of 2023 registered for the offences punishable under Sections 363, 366A, 34 I.P.C.

3. As per prosecution case, it is a case of abduction of the daughter of the informant by the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that victim returned home safe and sound on 07.12.2023 and gave her statement under Section 161 Cr.P.C that she was talking with petitioner who was her

No.15829 of 2024(2) dt.13-03-2024 2/2 cousin Bahnoi and her uncle scolded her for this then she went to Nawada with cousin Bahnoi (Petitioner) and as soon as she got knowledge that her father lodged case, she came back. It is also submitted that petitioner is in judicial custody since 08.12.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City in connection with Khusrupur P.S Case No. 496 of 2023.
