JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in a case registered under Sections 302, 120B and 34 of the Indian Penal Code and 27 of Arms Act.

It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in the present case due to previous enmity. There is no specific allegation against the petitioner. It is further submitted that no independent witness has come forward to support the case. It is also submitted that no where it is mentioned that the petitioner was ever carrying any fire arm. The petitioner is in custody since 18.11.2016.

No.20312 of 2017 (3) dt.04-07-2017 2/2 Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge, Rohtas at Sasaram connection with S.T.No. 27 of 2017 (arising out of Sasaram (Mufassil) P.S.Case No. 1254 of 2016).
