JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 302, 120(B), 34 of the Indian Penal Code and 27 of Arms Act.

It is submitted by the learned counsel for the petitioner that neither the petitioner is named in the FIR nor during investigation any witness has named this petitioner. No charge sheet has been submitted. It is further submitted that the petitioner is in custody since 02.11.2016.The name of the petitioner has come on the confessional statement of co-accused Ranjit Kumar before the police and save and except there is nothing against the petitioner. It is also submitted that similarly situated co-accused Vikky Kumar @ Vikky has been granted bail by a co-ordinate

Patna High Court Cr.Misc. No.22658 of 2017 (4) dt.04-07-2017 2/2 bench of this Court vide order dated 23.06.2017 in Cr.Misc. No. 22272 of 2017.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIIrd, Patna in Sessions Trial no. 133 of 2017 (Beur P.S.Case No. 241 of 2016).
