====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 92 of 2017, registered for the offence punishable under Sections 147, 148, 149, 307, 333, 353 of the Indian Penal Code and 25(1B)1/26/27/35 of the Arms Act. The case, according to the informant, is that he received information that some accused persons have assembled at Gopal Dera Road near temple, armed with weapons and planning to commit occurrence. The police is said to have reached at the spot and apprehended various persons and also prepared a seizure list. So far as petitioner is concerned, one cartridge is said to have been recovered from his pocket.

No.30809 of 2017 (2) dt.06-07-2017 2/2 The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the instant case, although he was not present near the place of occurrence, he has no criminal antecedent and he is a student of B.A. and is in custody since 10.04.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

According, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 92 of 2017.
