The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 144, 414, 120B of the Indian Penal Code and 17 of the C.L.A. Act. It is alleged that on information that some extremists have gathered, the police raided the party Maoist's office to apprehend few miscreants from whose possession arms, ammunitions and other articles were recovered, they suggested the name of petitioners, who managed to escape from the scene. It is submitted by learned counsel for the petitioners that no recovery has been made form the possession of the petitioner and similarly situated co-accused persons namely,

Patna High Court Cr.Misc. No.14649 of 2015 (2) dt.10-04-2015 2/2 Saheb Rai @ Saheb Kumar and Bindeshwari Giri have been granted anticipatory bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.19343 of 2014. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari in connection with Ghorasahan (Lakhaura) P.S. Case No.152 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
