Petitioner is languishing in judicial custody since 31.05.2017 in connection with Baghaila P.S. Case No. 28/2017 for offences punishable under Section 307 and other allied Sections of the Indian Penal Code and 27 of the Arms Act. The prosecution case, as lodged by the informant, is that while he was sitting at his door, the petitioner along with three other accused persons came and started abusing the informant. One Bahadur Singh instigated the accused persons to kill and also inflicted gandasa blow on the head of the informant. When his son came to rescue, all the accused persons also assaulted his son with lathi and petitioner is alleged to have taken
Patna High Court Cr.Misc. No.32132 of 2017 (3) dt.17-08-2017 2/2 Rs. 4,000/- from the pocket of the informant. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has been falsely implicated in the aforesaid case. He submits that both sides are on inimical terms, injuries are found to be simple in nature caused by hard blunt substance and that the allegation upon the petitioner is not of hitting the informant. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-3, Sasaram, in connection with Baghaila P.S. Case No. 28/2017.
