Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners, after some arguments, seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 2 (Md. Soyeb @ Md. Shoaib Alam).

Permission is accorded.

Accordingly, the instant anticipatory bail application is dismissed as withdrawn with respect to petitioner No. 2.

The petitioner Nos. 1 and 3 apprehend their arrest

Patna High Court CR. MISC. No.13749 of 2025(3) dt.12-05-2025 2/3 in a case registered for the offences punishable under Sections 341, 342, 323, 307, 325, 365, 379, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner No. 1 has antecedent of four cases and petitioner No. 3 has antecedent of three cases and the informant alleges that the accused persons came and forcibly took him to their house on a motorcycle and Md. Soyeb assaulted by butt of pistol causing breakage of four teeth, while other accused assaulted him by iron rod on head and back and thereafter tied him to an electric pole and took out Rs. 10,000/-.

The learned counsel for the petitioner next submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that specific allegation of assault is against Md. Soyeb and since petitioners have antecedent, as such they have been implicated with general and omnibus allegation of assault. It is also submitted that even injury suffered by the injured is simple in nature. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioner Nos. 1 and 3, above

Patna High Court CR. MISC. No.13749 of 2025(3) dt.12-05-2025 3/3 named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bakhri P.S. Case No. 396 of 2023, subject to the conditions as laid down under Section 482 (2) of the BNSS.
