2. The petitioner apprehends arrest in connection with in a case registered under Section 30(a) of Bihar Excise Act.
3. As per the prosecution case, there is recovery of about 3 liters of illicit country made liquor from the house of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Further submission is that petitioner was not present at the house at the time of alleged recovery of the illicit liquor. Petitioner has no concern with the seized liquor. The house where the recovery of illicit liquor was made belongs to the joint family. There is violation of mandatory provision with
Patna High Court CR. MISC. No.14885 of 2025(2) dt.02-04-2025 2/2 respect to the search and seizure. Petitioner is an old lady aged about 68 years having no criminal antecedent and she undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned D.J.-II-cum-Exclusive Special Judge (Excise-I), Kishanganj in connection with Paharkatta P.S. Case No. 114 of 2024, giving rise to Special Case No. 265 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
