The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

It is alleged that the petitioner received Rs.24,000/- for supply of X-ray machine and subsequently, Rs.1,25,000/- was also deposited by the informant in different accounts suggested by the petitioner, but X-ray machine could not be supplied. It is submitted by learned counsel for the petitioner that booking was made on behalf of the company and Rs.24,000/- was transferred to the petitioner and Rs.1,25,000/- was deposited by the informant in the different accounts of the company and the same was not given to the petitioner. The

Patna High Court Cr.Misc. No.14657 of 2015 (2) dt.10-04-2015 2/2 petitioner undertakes to deposit Rs.24,000/- before the learned court below which will be invested in some fixed deposit scheme in connection with the present case, which will be subject to result of the case. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Rohtas (Sasaram) in connection with Dehri Town P.S. Case No.318 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
