====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Maker P. S. Case No. 242/2024 in a case registered for the offences punishable under Sections 274, 275 of the Bharatiya Nyaya Sanhita and Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 845 litres of spirit was recovered from the banana orchard.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has been made accused only on suspicion. Petitioner is in custody since 23.12.2024.
5. Learned A.P.P. for the State vehemently opposed
Patna High Court CR. MISC. No.20785 of 2025(4) dt.18-04-2025 2/2 the bail application and submitted that petitioner has got three criminal antecedents of similar nature.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-cum-Presiding Officer, Exclusive Special Excise Court No. 3, Saran at Chapra in connection with Maker P. S. Case No. 242/2024.
