The petitioner seeks bail in a case registered for the offence under Sections 341, 384, 353, 307, 379, 411, 34 of the Indian Penal Code.

As per the prosecution case, one truck loaded with 800 cft. illegal stones (chips) was seized and thereafter, this petitioner and others are alleged to have attacked the driver of the truck, injured him and tried to manage the officials of Mining Department to release the vehicle and on refusal, they assaulted the officials of Mining Department. Petitioner is not named in the F.I.R. Name of the petitioner has come during course of investigation. Allegation of assault is general and omnibus in nature. Similarly situated coaccused Vikash Kumar has already been granted bail, vide order

Patna High Court CR. MISC. No.14646 of 2022(2) dt.12-05-2022 2/2 dated 10.05.2022 passed in Cr.Misc. No. 13229 of 2022. Petitioner is in custody since 06.01.2022.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Muffasil P.S.
