The petitioner seeks bail in a case registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation, six cartoons and 11 bottles of foreign liquor have been recovered from the vehicle which was also being boarded by the petitioner. It is also contended that petitioner has no connection with the aforesaid items. Petitioner claims his antecedent to be clean and he is in custody since 15.05.2017. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with

Patna High Court Cr.Misc. No.32368 of 2017 (2) dt.13-07-2017 2 / 2 two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge-cum-Special Judge, Darbhanga in connection with G.O. Excise Case No.848/2017 arising out of Simri P.S. Case No.48/2017.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
