====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-04-2025 Learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with regard to petitioner No. 1.

2. Permission is granted.

3. This anticipatory bail application with regard to petitioner No. 1 is, accordingly, dismissed as withdrawn.

4. Heard learned counsel for the petitioners and the State.

5. Petitioner Nos. 2 to 8 apprehend arrest in a case registered for the offences punishable under Sections 316(2), 318(4), 338, 336(3) of the Bharatiya Nyaya Sanhita.

6. As per prosecution case, informant purchased 4 katha land vide sale deed dated 20.06.24 from one Sunita Sahay and came in possession of the same. It is alleged that co-accused Raj Kumar Raut and Gond Raut fraudulently sold the land of informant in favour of these petitioners.

7. Learned counsel for the petitioners submits that petitioners are bona fide purchasers and purchased the land in question from co-accused Raj Kunar Raut and Gond Raut after payment of due consideration amount. For the same piece of land, title suit No. 158 of 2020 is already pending before the learned court below. Moreover, dispute is regarding sale and purchase of land which is purely of civil nature.

8. Learned A.P.P. for the State vehemently opposed the bail application.

9. Considering the nature of accusation and aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner

Patna High Court CR. MISC. No.17071 of 2025(2) dt.02-04-2025 3/3 Nos. 2 to 8 in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Saran at Chapra in connection with Rivilganj P. S. Case No. 297 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
