JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No. 27 of 2015 registered for the offences punishable under Sections 147, 149, 341, 342, 323, 337, 353, 332, 435, 427, 504, 506 of the Indian Penal Code.

Petitioner is named in the first information report and it is alleged that he as well as one other instigated the mob at the time of alleged occurrence and on the instigation of petitioner and other accused, the mob pelted bricks and stones on the police personnel and others in protest of a road accident. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is

No.14903 of 2015 (2) dt.10-04-2015 allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Jagdishpur P.S. Case No. 27 of 2015 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
