The petitioner wants to renew the prayer of bail which was earlier rejected vide order dated 19.12.2016 passed in Cr. Misc. No. 51592 of 2016, on the ground that the petitioner is suffering in custody since 07.05.2016, he is not named in the F.I.R. later on in the further statement the informant has named the petitioner falsely. Other co-accused has been allowed bail and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of bail by submitting that not only the informant other witnesses have also named the petitioner and he has got criminal antecedent. In the facts and circumstances stated above,

Patna High Court Cr.Misc. No.9279 of 2018(3) dt.07-03-2018 2/2 finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected in connection with Sitamarhi P.S. Case No. 211 of 2016 pending in the court of learned C.J.M., Sitamarhi.

However, considering the detention of the petitioner, the learned trail Court is directed to expedite the trial and conclude the same preferably within six months, from date of receipt/production of a copy of this order, failing which if the petitioner at no fault, may be at liberty to renew his prayer for bail.
