2. The petitioner apprehends his arrest in a case registered for the offence under Sections 7 of the E.C.Act.
3. On a complaint by consumers, physical verification was done in the P.D.S. shop of petitioner and 12 quintal wheat and 70 quintal of rice were found shortage. It is alleged that aforesaid foodgrains were sold by petitioner in the black market.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He is PDS dealer from 1993 and before this issue, there was no complaint against petitioner by any consumer. In fact, it was due to defective e-POS machine, the above shortage was found. In this regard, petitioner has already filed several complaints, but same
Patna High Court CR. MISC. No.16654 of 2025(3) dt.28-04-2025 2/2 was not taken into consideration by the officials. Moreover, by way of filing supplementary affidavit, learned counsel for the petitioner submits that during pendency of this case, the license of the PDS shop of petitioner has already been suspended by the Sub-Divisional Officer, Katihar, vide Memo no. 374/vk0 dated 28.09.2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Katihar / concerned Court in connection with Falka P.S. Case No. 167 of 2024, subject to condition as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
